Terms of Service

1. Agreement to these terms

These Terms of Service (“Terms”) are a legal agreement between you and TryStudio (“TryStudio”, “we”, “us”, or “our”) and govern your access to and use of our website, seller dashboard, hosted storefronts, and related services (together, the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

If you use the Service on behalf of a business, you confirm that you are authorised to bind that business to these Terms.

2. The Service

TryStudio lets sellers build and run online stores — hosted on a trystudio.io subdomain or a connected custom domain — with themes, product management, checkout, mobile-wallet payments (bKash and Nagad) and cash on delivery, courier delivery (Pathao and Steadfast), analytics, and an AI Studio (virtual try-on and product image/video generation). Features available to you depend on your subscription plan. We may add, change, or remove features over time.

3. Accounts, eligibility, and security

To use most features you must create an account, provide accurate information, and verify your mobile number by OTP. You must be old enough to enter into a binding contract under the laws of Bangladesh. You are responsible for keeping your password, two-factor codes, and backup codes secure, and for all activity that occurs under your account. Notify us immediately if you suspect unauthorised access. We may suspend or terminate accounts that are inactive, fraudulent, or in breach of these Terms.

4. Plans, fees, and payment

TryStudio offers Free, Pro, and Business plans. Paid plans are billed in Bangladeshi Taka (BDT) for a fixed period, and each store also pays a usage-based per-delivered-order fee that varies by plan: ৳10 on Free, ৳7 on Pro, and ৳5 on Business. Certain features, such as AI Studio try-on, image, and video generation, consume prepaid credits.

• Paid plans are for a fixed period and do not renew automatically. To stay on a paid plan, re-subscribe before it ends; otherwise your account returns to Free. You authorise us to charge your selected payment method (bKash or Nagad) for the fees you confirm.
• Per-delivery fees are charged for delivered orders regardless of plan, including on the Free plan.
• Delivery-fee update: stores created on or before 23 September 2026 continue to pay the previous ৳3 per-delivered-order rate until 23 December 2026, after which the plan rates above apply. Stores created after 23 September 2026 pay the plan rates immediately.
• Plan limits — such as the number of stores you may run — apply to your account. Downgrading may require you to bring your usage within the new plan’s limits.
• Except where required by law, fees are non-refundable. Prepaid credits are non-refundable and may expire.
• We may change prices, plans, or fees on reasonable notice; changes take effect on your next billing period.
• You are responsible for any taxes associated with your use of the Service other than taxes based on our income.

5. Your content and stores

You retain ownership of the products, images, text, branding, and other content you upload or create (“Your Content”). You grant TryStudio a worldwide, non-exclusive licence to host, store, process, transmit, display, and adapt Your Content solely to operate and provide the Service — for example to render your storefront, generate AI outputs you request, and deliver orders. You are responsible for Your Content and for ensuring you have the rights to use it and that it does not infringe others’ rights or break the law.

6. Acceptable use

You agree not to use the Service to, and not to allow anyone else to:

• Sell illegal, counterfeit, stolen, or prohibited goods or services, or engage in fraud, deceptive practices, or money laundering.
• Upload or distribute content that is unlawful, infringing, defamatory, obscene, or that violates the intellectual-property, privacy, or other rights of others.
• Transmit malware, attempt to breach or probe security, disrupt the Service, or gain unauthorised access to accounts, systems, or data.
• Scrape, resell, or misuse the Service or other users’ data, or use it to send spam or unlawful communications.
• Abuse AI features to generate unlawful, harmful, or infringing material, or misrepresent AI-generated content in a way that deceives buyers.
• Violate any applicable law or regulation, or the rules of our payment or courier partners.

We may remove content, suspend stores, or terminate accounts that breach this section, and may report unlawful activity to the authorities.

7. Payments, orders, and delivery

TryStudio provides the technology that connects your store to payment gateways and couriers, but the sale is between you (the seller) and your buyer. You are responsible for your products, pricing, order fulfilment, customer service, returns, refunds, and for complying with consumer-protection and other applicable laws. Payment processing is provided by bKash and Nagad and delivery by Pathao and Steadfast, each subject to their own terms; we are not responsible for the acts, omissions, or availability of these third parties.

8. Domains and subdomains

We provide a free trystudio.io subdomain for each store and, on eligible plans, let you connect a custom domain with HTTPS. You are responsible for owning and maintaining any custom domain and for configuring it correctly. We may reclaim subdomains that are unused, abusive, or that infringe third-party rights.

9. Intellectual property

The Service, including our software, themes, templates, branding, and website, is owned by TryStudio or our licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms. You may not copy, modify, resell, reverse-engineer, or create derivative works of the Service except as permitted by law. “TryStudio” and our logos may not be used without our permission.

10. AI-assisted features

Our AI Studio uses third-party AI providers (Google Gemini and Veo) to generate or edit product images, try-on visuals, and marketing videos at your request, and these features consume AI credits. AI output can be inaccurate, generic, or unexpectedly similar to other output, and you are responsible for reviewing it before use and for ensuring it complies with these Terms and applicable law. You must have the rights to any images or garments you upload for try-on or generation, you must not upload another person’s likeness without their permission, and you are responsible for the prompts and inputs you submit and for the outputs you publish. Credits consumed by AI generation are non-refundable.

11. Third-party services

The Service integrates with and links to third-party services (including payment, courier, cloud, communications, and AI providers). Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services, and their availability or changes may affect the Service.

12. Suspension and termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms, fail to pay fees, create risk or legal exposure, or if we discontinue the Service. On termination, your right to use the Service ends and we may delete your data after any legally required retention period. Fees already incurred remain payable. Sections that by their nature should survive termination (including payment, intellectual property, disclaimers, limitation of liability, and governing law) will survive.

13. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that it will meet your requirements, or that AI outputs or third-party integrations will be accurate or available.

14. Limitation of liability

To the maximum extent permitted by law, TryStudio and its affiliates, officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business, arising out of or related to your use of the Service. Our total aggregate liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the three (3) months before the event giving rise to the claim.

15. Indemnity

You agree to indemnify and hold harmless TryStudio and its affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of Your Content, your stores, your products, your breach of these Terms, or your violation of any law or the rights of a third party.

16. Governing law and disputes

These Terms are governed by the laws of Bangladesh, without regard to conflict-of-laws rules. You agree that the courts of Dhaka, Bangladesh have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, subject to any mandatory rights you have under applicable law.

17. Changes and contact

We may update these Terms from time to time. When we make material changes we will update the “Last updated” date above and, where appropriate, notify you. Your continued use of the Service after an update means you accept the revised Terms.
